Lodging with the Land Titles Office

On 2 January 2024, the Land Legislation Amendment Act 2023 changed how transactions are done at the Land Titles Office (LTO).

The changes means you must:

  • verify your identity for all property transactions as a self-representative or
  • provide authorisation if you’re appointing a representative.

The changes will also allow for electronic conveyancing (e-conveyancing) to be introduced at a later time.

Verification of identity for LTO transactions

The identities of the parties involved in an LTO transaction must be verified.

Self-represented parties

If you have not appointed someone to represent you in your transaction, you can verify your identity through:

  • legal practitioners or conveyancers
  • Australia Post - learn more on the Australia Post website
  • verification of Identify (VOI) agents

Appointed representative

If you have appointed a legal practitioner or conveyancer, your identity will be verified as part of their service.

Authorising an appointed representative for LTO transactions

A client authorisation form DOCX (67.1 KB) must be completed by a:

  • law practice
  • legal practitioner
  • conveyancing agent.

This authorisation allows them to finalise the transaction on your behalf.

The form requires signatures from the client and either a:

  • legal practitioner
  • registered conveyancer.

Signing the form also certifies that all steps have been taken to verify the identity of the client.

Signed forms need to be kept as evidence of authority for 7 years, starting from the date the last instrument is lodged with the LTO.
