Fencing and boundary disputes

Fencing and boundary disputes are common disagreements between neighbours.

In the Northern Territory (NT) rules about fencing are set out in the Northern Territory Fences Act 1972.

You need to understand your rights and responsibilities over the following:

  • existing fencing
  • how to establish your legal boundary line
  • sharing the cost of building and maintaining fencing between properties.

If you can't agree with your neighbour

The NT Community Justice Centre can help with mediation if you cannot resolve a dispute with a neighbour.

Find out more about mediation.

Before you build a fence

Before you start any fencing works you must check the rules and regulations including if you need to apply for a building permit.

You will find this information at building a garden shed, carport, fence or shade structure.

For information on regulations and building permits go to building and renovating: permits and processes.

Swimming pool and spa fencing

There are rules that apply to swimming pool and spa fencing and also the use of dividing fences between properties as part of a pool safety barrier.

Go to swimming pool and spa fencing for more information.
