Tobacco licences

Tobacco licensing regulates tobacco packaging, advertising and display. It also prohibits the sale and supply of tobacco and other smoking products to children.

It is an offence to sell tobacco without a licence in the Northern Territory (NT).

The NT Tobacco Control Act 2002 was amended in 2019 to include electronic cigarettes (e-cigarettes), and their accessories, as regulated products.

Like traditional tobacco products, the sale of e-cigarettes requires a tobacco retail licence and the same restrictions that apply to the sale and consumption of tobacco apply to e-cigarettes.

Rules for tobacco retailers

If you are a tobacco retailer, you must follow these rules:

  • Tobacco products must not be sold by employees under the age of 18.
  • All tobacco products (excluding e-cigarettes and their accessories) must be sold in plain packaging.
  • Tobacco products cannot be advertised or displayed at point of sale.

You must have a tobacco licence to sell tobacco in the NT.

You can apply for a one-year, three-year or five-year licence.  A licence will expire on the anniversary of the date it was issued.

How to apply

To apply, follow these steps.

Step 1. To apply online, go to Licensing NT Online or fill out the tobacco licence form.

Step 2. Get a police history check.

Step 3. Check the fee.

Step 4. Submit your application and fee at your nearest Territory Business Centre.

Tobacco licences issued in the Northern Territory are valid for one, three or five years. They must be renewed before they expire.

How to renew

To renew follow these steps.

Step 1. To renew online, go to Licensing NT Online or fill out a renew a tobacco licence form appropriate for your business type:

Company

Step 2. Get any new managers to complete a police history check.

Step 3. Check the fee.

Step 4. Submit your application and fee at your nearest Territory Business Centre.

A tobacco licensee in the NT can transfer their licence to any of the following:

  • an individual
  • a company
  • a partnership
  • an association.

How to transfer a tobacco licence

To transfer a licence follow these steps.

Step 1. To transfer online, go to Licensing NT Online or fill out the transfer a tobacco licence form.

Step 2. Get a police history check.

Step 3. Submit your application and fee at your nearest Territory Business Centre.

A tobacco licensee can apply to change the manager of their tobacco licence.

Step 2. Get the proposed manager to complete a police history check.

Step 3. Submit the application and fee at your nearest Territory Business Centre.

Smoking signage

Tobacco retailers in the NT must display both of the following signs:

  • a tobacco health warning
  • a notice prohibiting selling or supplying tobacco to children

You must display at least one of these four health signs where you sell tobacco.

Where to get smoking signs

You will receive free signs after you apply or renew your tobacco licence.

You can also phone the Tobacco Hotline in 1800 888 564 to request free signs.

Tobacco licence fees

You have to pay to apply or renew a tobacco licence in the NT.

Fees do not include GST.
