Complain about a real estate professional

You can complain about real estate professionals including real estate agents, conveyancing agents, business agents and agent's representatives. This can be done under section 44 or section 68 of the Agents Licensing Act 1979.

Types of complaints

A complaint can be made about any action or inaction of an agent or agents representative within the boards juristiction. It must be a breach of the Act or rules of conduct. This includes failing to:

  • act in your best interests
  • carry out a lawful instruction
  • exercise due skill, care or diligence.

Before you submit a complaint

You should raise any concerns with the business manager of the agency involved in an attempt to resolve the issues. Do this before lodging your application for disciplinary action.

An application for disciplinary action can't award compensation or reimbursement for financial loss incurred by an agent or agents representative.

You must include the following information:

  • the grounds
  • alleged breach
  • specific details of what happened
  • any evidence.

Submit your completed form to Occupational Licensing along with all supporting documents in person, by email or post.
